Welcome to ellgeeBE - a space to discover and book your LGBTQ-friendly vacation. ellgeeBE is a comprehensive search platform wherein local experts from hundreds of cities across North America, South America and Europe provide information about LGBTQ-specific and/or LGBTQ-friendly businesses, hotels, outdoor destinations, family activities and nightlife.

ellgeeBE strives to ensure that LGBTQ individuals, couples, and families have exciting, memorable vacations in safe spaces around the world. ellgeeBE provides LGBTQ travelers with the resources to create the ideal group or individual LGBTQ-friendly vacation.

These Terms of Service in conjunction with our Privacy Policy and Cookies Policy govern your viewing or use of the ellgeeBE website (the "Site") and your affiliation with the owner of the Site (the "Site Owner"). By using this Site in any capacity, you agree to be bound by these Terms of Service.

Terms of Use: When using our site, you represent that you understand and will comply with the following Terms of Use.

A. Availability of the Site

Access to the Site is permitted at the Site Owner's discretion. ellgeeBE reserves the right to withdraw, amend, restrict or otherwise modify the Terms and Conditions at any time, at our sole discretion, and without notice, prior or otherwise. Your continued access or use of this Site signifies your acceptance of the updated or modified Agreement.

B. Privacy Policy and Disclosures

ellgeeBE is committed to protecting your privacy. The Privacy Policy, in addition to the Terms of Service, governs your use of this Site. Please click here to view our Privacy Policy.

  1. In certain instances, ellgeeBE may be asked to provide your personal information to observe lawful and enforceable governmental requirements, requests, summonses, court orders, or subpoenas. ellgeeBE will, in our soul discretion, determine whether to observe or disregard these orders or requests. ellgeeBE's right to release Site user information, including without limitation any and all user profile information, posted content, usage history, IP addressing and user traffic data, will hold precedence over any and all terms of ellgeeBE's Privacy Policy.
  2. We reserve the right to remove photographs at our sole discretion if they do not meet these Terms or are otherwise unacceptable to us. By submitting a photograph to ellgeeBE, the members represent and warrant that
    1. they hold all intellectual property rights to each submitted photograph, or have secured from the copyright holder all rights necessary for the photograph to be used in an online advertisement,
    2. that any people in the photograph have given permission for their likeness to be displayed in an online advertisement on the Site,
    3. that the photograph accurately and fairly represents the subject of the photograph and has not been altered in any manner that would mislead a viewer of that photograph, and
    4. that it will indemnify and hold harmless ellgeeBE from any cause of action arising from any misrepresentation with respect to any and all photographs so submitted. It is the member's responsibility to obtain reproduction permission for all photographic and other material used in posts or profiles. The member warrants that it is the owner of the copyright in such material or is authorized by the owner thereof to grant to us the rights therein contained and agrees to provide any proof of such rights to us that we may request. Further, each member agrees that we may reproduce in whole or in part any photographic material supplied by such member.
  3. We reserve the right to remove or disable hypertext links to, or addresses of, other web sites from members' pages without notice at our sole discretion.

C. Prevailing Language

This Terms of Service is created in the English Language. Any translation of this document into a different language is for accessibly and information purposes only. In cases of disagreement or conflict between the English version of this document and that created in any other language, the English version of the document shall predominate.

D. Content Guidelines

As a user of the ellgeeBE Site, you agree not to engage in, assist another in engaging in, or otherwise enable another user to :

  1. write a fake or defamatory review
  2. trading reviews with other third party providers
  3. bribing or compensating someone for writing, altering, deleting or otherwise changing a review
  4. using the ellgeeBE platform to promote a commercial venture, event, or business or to use the site for commercial resolves unless operating as a licensed ellgeeBE third party expressly permitted by ellgeeBE to do so
  5. use an automated device, including but not limited to site search/retrieval tool, robot, spider, or any other automated means to scrape, retrieve, or otherwise access the ellgeeBE Site or any Site content

E. Ownership

You own any Content that you upload, post, transmit, message or otherwise provide on the ellgeeBE Site. ellgeeBE owns all ellgeeBE Content, including but not limited to interactive features, forums, interfaces, graphics, design and complications, including, without limitation, any complication of user Content, Site content, Software, code, products, user reviews, and any other portion or part of the Site excluding User content.

F. Unauthorized Uses

The Site Owner, in its sole discretion, may determine which uses of this Site are improper and/or unauthorized. The Site Owner may take any appropriate action in response to unauthorized uses of this Site and/or violations of the Terms and Conditions, including but not limited to blocking any user from this Site. You agree not to use this Site:

  1. to supply untrue information or other misrepresentations;
  2. in violation of any legal agreement with an external party;
  3. if you are a minor as defined under the laws of your jurisdiction or residence;
  4. to post, transmit or otherwise make available any material that contains any computer code, files, or programs intended to corrupt, destroy or limit the functionality of any computer hardware, software, or telecommunications equipment;
  5. to violate, either intentionally or unintentionally, any national or international statute, decree, law, rule and/or regulation;
  6. to copy, re-sell, monitor, download, display, or reproduce any content, products software, or services available on the ellgeeBE Site for any competitive or marketable purpose or activity;
  7. to harass, intimidate, or "stalk" another person including but not limited to using abusive language such as racist, homophobic, or sexist slurs; or
  8. to collect or store personal data about others.

G. Removal of Registration

ellgeeBE reserves the right to refuse a user access to the Site and/or to delete the user's registration. The user may also terminate their own access and registration at any time.

  1. ellgeeBE may, in its sole discretion, limit any user's access to its Services, or terminate any user's account at any time for a reason.
  2. if ellgeeBE finds you in breach of these Terms, or any other policy included in the Site Privacy Policy or Cookies Policy, we may, at our sole discretion, without prior notice, and at any time:
    1. discontinue your access to the site and to our services.
    2. delete or deactivate your account and all Content, files, information related to your account.
    3. prevent you from accessing any such Content, files, information or services.
  3. in any of the above cases, a Site user is not permitted to register for a new ellgeeBE account without first receiving written consent.

H. Service Fees

ellgeeBE will not charge users for any provided services. Fees and charges are determined and collected solely by external accommodations.

I. External Providers and Booking an Accommodation

All bookings and interactions that originate through ellgeeBE's provided services are the private transactions between the Site user and the respective external site.

  1. ellgeeBE acts as a platform wherein users can independently establish travel itinerary through connecting with external providers. ellgeeBE is not a travel agency and does not act as a travel organizer for Site users. Through arranging a reservation with a respective organizer or travel agency through the ellgeeBE platform, you accept and agree to their independent policies, including, but not limited to, cancelling and booking policies, Terms and Conditions, and Privacy Policies. Provider policies can be obtained through respective providers.
  2. All contact between Site users and providers occurs through the respective provider site. Contact includes, but is not limited to, booking, payments, and questions about the provider contract. ellgeeBE will remain uninvolved in all contractual provisions, agreements and claims between the ellgeeBE user and the respective external contracting provider.

J. Travel Documentation and Requirements

  1. ellgeeBE at no time accepts liability for travelers who are refused access to a flight or to a travel destination because of the traveler's failure to provide correct travel credentials or documents required by an airline, authority, temporary layover destination, or travel destination. To determine correct travel document information and requirements, including visas and passports, travelers should confer with the corresponding consulate or embassy.
  2. Currency rates provided on ellgeeBE's platform, by either the Site itself or by Site users, are based on public sources and should be regarded as general guidelines. ellgeeBE does not claim that the rates are accurate and assumes no responsibility for inaccuracies. When referencing the Site for any financial determination, ellgeeBE recommends you confirm the accuracy of the currency rates by conferring with a certified professional.

K. Ranking and Guest Reviews

  1. ellgeeBE's Default Provider Ranking is based on user reviews where available. The default ranking will not inhibit the Site user from ranking providers in alternate ways based on its discretion. Please note that the Default Ranking is based on an automatic algorithm and does not reflect bias on the part of the Site owner.
  2. Site users may fill out a Provider Ranking survey ("User Review") to inform the Site and future Site users of their experiences. The completed Provider Ranking may be :
    1. uploaded onto the relevant provider information page on our website for the purpose of informing future Site users of their opinion of the quality of service, and
    2. used and/or placed, wholly or partly, by ellgeeBE at its sole discretion and without notice for marketing, promotion or improvement of our services, on our Site; social media platforms; newsletters; special promotions; apps or other channels owned, hosted, used or controlled by ellgeeBE and our business partners.
    3. The Site Owner reserves the right to refuse, remove, or adjust reviews at its sole discretion. The Provider Ranking form should be exclusively regarded as a survey and does not include any further commercial offers, invitations or incentives whatsoever.

Trademark Material may not, in whole or in part, be plagiarized, copied, imitated or employed without previously written consent from ellgeeBE or the appropriate holder of the Trademark Material. N. DISCLAIMER OF WARRANTIES

ALL AMENITIES OFFERED ON THE ELLGEEBE SITE ARE "AS IS" AND "WHERE IS" WITH NO IMPLIED WARRANTY OR GUARANTEE OF ANY KIND REGARDING THE CORRECTNESS, COMPLETENESS, RELIABILITY, OR LEGALITY OF THE CONTENT OF THIS SITE. ANY WARRANTY THAT IS SUPPLIED IN CONNECTION WITH ANY PROVIDER ON THE SITE IS DETERMINED BY AND LIMITED TO THE WARRANTIES PROVIDED BY THE RESPECTIVE PROVIDER. Q. Definitions

  1. Parties: A "user" is one who in any way uses the Site. This includes crawling, browsing, scraping, accessing or any other method of interacting with the ellgeeBE website. References to "You" and "your" refer to the Site user. "We," "us," and "our" refer to ellgeeBE.

"Site Content" refers to all Content that is made accessible in relation to the Site, including "Your Content", "User Content", Content that ellgeeBE supplies independently, and "Third Party Content".

R. Belief of Copyright Infringement

If you believe your intellectual property has been copied and reposted on this Site in such as way as to represent copyright infringement, please contact our Copyright Agent and include all of the following details.

  2. URL or equivalent means for locating infringed material.

ellgeeBE Community Calendar Terms of Use

ellgeeBE Corp. provides a marketplace in which attendees/users and organizers can transact but is not responsible for the actions or inactions of different attendees, organizers and/or third parties both on and off the services.

By submitting an event or using the ellgeeBE Community Calendar, you agree that you have read and agree to these Terms & Conditions, releasing ellgeeBE Corp., and its affiliates and subsidiaries, and each of its and their respective officers, directors, agents, partners and employees from any liability for all damages, losses, liabilities, costs and expenses of any kind, known and unknown, arising out of or in any way connected with disputes between you and third parties (including other Users) in connection with the Services or any event listed on the Services.

EVENT SUBMISSION

There is no fee to have your event listed.

Please note that all events are subject to approval, and ellgeeBE reserves the right to eliminate or edit any submitted event information to ensure consistency of style and tone.

  1. To be included, events should appeal to visitors to your area, particularly the LGBTQ community and include all applicable information (i.e. date and time, location, description of the event).
  2. Listings should include photos and must be a minimum of 1920 px wide and comply with our photo guidelines.
  3. ellgeeBE will not list any events that encourage or support any form of discrimination, potential dangerous or hateful behavior.
  4. Annual and permanent events will not be listed on the Community Events calendar i.e. annual festivals, Pride parades, permanent exhibitions. These are listed on and may be submitted to our Pride & Events Calendar.

To the extent permitted by applicable law, the community event listings are provided as submitted by the organizers and on an available basis. ellgeeBE therefore disclaims all warranties of any kind i.e. does not guarantee that the events or services or any portion of the events or services will:

  1. Meet the requirements or expectation of organizers or users.
  2. Be error free, accurate or reliable.
  3. Be secure.

Registered users and visitors to www.ellgeebe.com aknowledge that ellgeeBE does not:

  1. Control content submitted by third parties (organizers or users)
  2. Guarantee the quality, safety, truth or legality of the events posted or content provided by attendees in response to the listing
  3. Assume any responsibility for all liability arising from the acts or omissions of third parties using ellgeeBE services.

To the extent permitted by applicable laws, ellgeeBE Corp., and its affiliates and subsidiaries, and each of its and their respective officers, directors, agents, co-branders, licensors, payment processing partners, other partners and employees, shall not be held liable under any circumstance or under any legal theory for:

  1. Any and all damage - whether indirect, direct, incidental, consequential, special, punitive or exemplary - including but not limited to loss of profits or goodwill, liability, cost and expense resulting from any claim, demand, suit, proceeding (whether before an arbitrator, court, mediator or otherwise) or investigation made by any third party (each a "Claim") resulting from the use of ellgeeBE services
  2. Any improper use of the Services by any third party;
  3. Any breach of any applicable local, state, provincial, national or other law, rule or regulation or the rights of any third party;
